These Terms & Conditions (“Terms”) govern your access to and use of the Texas Food Lovers website, mobile applications, membership programs, and related services (collectively, the “Services”) operated by Texas Food Lovers, LLC (“Texas Food Lovers,” “TFL,” “we,” “our,” or “us”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make purchases.

If registering a business, you represent that you are authorized to act on behalf of that business.

2. Accounts

You agree to provide accurate, current, and complete information during registration.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us immediately of unauthorized use of your account.

3. Memberships & Subscriptions

Texas Food Lovers offers both free (Basic) and paid (Featured) listings for businesses, as well as consumer membership options.

Fees, pricing, and benefits are clearly disclosed at the time of purchase or upgrade.

Subscriptions may renew automatically unless canceled in accordance with the instructions provided in your account dashboard.

All sales are final unless otherwise stated. Refunds are handled at our sole discretion.

4. VIP & Loyalty Cards

Limited-edition VIP cards and other membership cards are subject to availability.

Cards must be valid and current to be honored at participating businesses.

Replacement for lost or stolen cards may incur a fee and is not guaranteed.

5. Business Listings

By submitting information for your restaurant, bar, food truck, winery, distillery, or other food-related business, you represent that the information is accurate and lawful.

You grant Texas Food Lovers a license to display, distribute, and promote your listing content across our Services.

Featured listings may include enhanced visibility, promotional tools, analytics, and other premium features.

6. User Conduct

You agree not to use our Services to:

Post false, misleading, or defamatory information.

Infringe on the intellectual property or rights of others.

Interfere with or disrupt our Services, servers, or networks.

Attempt to gain unauthorized access to our systems or accounts.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Rewards, Discounts & Gamification

Texas Food Lovers offers loyalty rewards, gamification features, and discounts at participating businesses.

Availability and value of rewards or discounts are subject to change without notice.

Businesses may set restrictions (such as blackout dates, excluded menu items, or time limitations).

Texas Food Lovers is not responsible if a participating business fails to honor a discount, perk, or reward.

8. Payments & Billing

Payments are processed securely through third-party providers.

You agree to pay all fees and charges associated with your account on time.

Taxes may apply depending on your jurisdiction.

9. Intellectual Property

All content on our Services (logos, trademarks, text, images, videos, software) is the property of Texas Food Lovers or its licensors.

You may not reproduce, modify, distribute, or exploit our content without prior written consent.

10. Disclaimer of Warranties

Our Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law:

Texas Food Lovers is not liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Services.

Our total liability to you for any claim is limited to the amount you paid (if any) in the past 12 months for use of the Services.

12. Indemnification

You agree to defend, indemnify, and hold harmless Texas Food Lovers, its affiliates, officers, employees, and partners from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violations of these Terms or other harmful conduct.

You may cancel your account at any time through your dashboard or by contacting us.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes shall be resolved in state or federal courts located in Harris County, Texas.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the new Terms.
